Dr. Conrad Murray, Michael Jackson’s physician, has been charged with involuntary manslaughter in connection with administering propofol, a powerful sedative that is most commonly used for anesthesia, to Jackson on the day he died.
Dr. Murray was the last doctor that saw Jackson alive and sources believe there is enough evidence that he will be found to have been responsible for the death of Jackson. The doctor’s administration fo the drug complicated the case because he was not breaking the law when giving it to him, however, there may have been a toxic mixture of drugs.
Court documents reveal that Murray told police he was giving Jackson 50 mg of Propofol every night via IV to help him sleep. They also indicate Murray suspected Jackson had an addicition to propofol and tried to wean him from the drug. The documents further suggest the doctor was deceptive about the extent of his administration of the drug.
Jackson’s celebrity status has brought this case within the realm of O.J. Simpson with huge media coverage, paparazzi mayhem, and the overwhelming sense of a disgruntled public.
Although Murray’s actions were seemingly unintentional, the case will put a spotlight on the medical malpractice field and the improper administration of drugs amongst celebrities.
“This is absolutely a slam-dunk malpractice case simply because of the alleged use of propofol,” says Bill Newkirk, an L.A. medical malpractice attorney. “If the drug was indeed in his system, no competent doctor could justify why it was used. You can bet the Jackson family will be filing a civil claim soon against any doctors implicated in Jackson’s medical care.”
Prosecuting doctors for patient deaths is difficult because it must be shown that a doctor was not only negligent, which would warrant state medical board action, potential loss of license, and a medical malpractice claim, but that he was acting far outside the standard of care, with extreme negligence.
In a previous trial involving a dead celebrity, a Tennessee jury found Elvis Presley’s doctor not guilty of negligently prescribing drugs to the famous artist whose body was found to contain 14 stimulants and depressants at the time of his death in 1977.
